Why this hire matters more than you think

In a divorce involving carried interest, the forensic accountant isn’t a supporting player — they’re the lead analyst. Your attorney advocates for you. Your forensic accountant builds the financial case that your attorney presents.

A great forensic accountant will uncover carry allocations you didn’t know existed, model future distributions with defensible assumptions, apply the right apportionment methodology, and explain everything in language a judge can follow. A mediocre one will miss assets, use boilerplate assumptions, and crumble under cross-examination.

The difference can be worth hundreds of thousands — or millions — of dollars. Here’s how to tell them apart.

Experience questions

Start here. Carried interest is a niche asset class, and most forensic accountants have never touched it.

Questions to ask

“How many cases involving carried interest have you worked on?” You want a specific number. “Several” or “a few” isn’t good enough. Look for at least 5–10 carry-specific cases.
“What types of funds were involved?” Venture capital, private equity, growth equity, real estate, and hedge funds all have different carry structures. Ideally, your expert has experience with the specific fund type relevant to your case.
“Have you worked on cases involving multiple funds with carry at different stages?” This is the norm in carry cases. If they’ve only handled single-fund scenarios, they may not be prepared for the complexity of your situation.
“Have you testified in court or deposition regarding carried interest valuation?” Testimony experience matters. An expert who has never been cross-examined on their carry methodology is untested.

What good looks like

A strong candidate will answer with specifics: “I’ve worked on 12 cases involving carried interest over the past 6 years. Eight were private equity, three were venture capital, one was a real estate fund. In four of those cases, I testified at trial.” They’ll mention the complexity of multi-fund analyses without being prompted.

Methodology questions

The apportionment methodology your forensic accountant uses will directly determine the community’s share. You need to understand their approach — and their reasoning.

Questions to ask

“Which apportionment methodology do you typically use for carried interest, and why?” Listen for whether they mention specific methods by name — Nelson, time rule, life of the fund, deal-by-deal attribution. An expert who speaks in generalities (“we use a time-based approach”) may not have deep carry experience.
“How do you handle carry in funds that haven’t yet made distributions?” This is the hardest part of carry valuation. You want to hear about probability-weighted scenario modeling, NAV-based estimates with appropriate discounts, and sensitivity analysis — not a single point estimate.
“What discount rates do you apply, and how do you justify them?” Illiquidity discounts, risk-of-forfeiture discounts, and time-value-of-money discounts are all legitimate. But they should be supported by data or comparable transactions, not pulled from thin air.
“How do you distinguish between vested and unvested carry for apportionment purposes?” This is a nuanced question. A good expert will explain how unvested carry that was “earned” during the marriage may still have a community component.

What good looks like

The ideal answer demonstrates flexibility: “I don’t default to a single methodology. I evaluate the specific facts — when the spouse joined, the fund’s lifecycle, the nature of their contributions — and select the approach that most accurately captures the community’s interest. In most cases, I run multiple methodologies and present a range.”

Communication questions

Technical skill is worthless if your expert can’t communicate. In a divorce case, the audience isn’t other accountants — it’s a judge, a mediator, or opposing counsel, none of whom may understand fund economics.

Questions to ask

“Can you explain carried interest to someone with no finance background in under two minutes?” Ask them to do it right there in the interview. If they can’t simplify it for you, they can’t simplify it for a judge.
“How do you present your findings in a report?” Look for structured reports with executive summaries, clear methodology sections, supporting exhibits, and sensitivity analyses. Ask to see a redacted sample if possible.
“How do you handle cross-examination on your methodology?” An experienced expert will describe how they prepare, anticipate challenges, and defend their assumptions without becoming defensive or evasive.

What good looks like

A composite example of a great answer: “I think of my report as a teaching document. The judge needs to understand three things: what carried interest is, how much of it is community property, and what it’s worth. I structure everything around those three questions. In testimony, I use analogies and visual aids. I’ve found that a simple timeline graphic does more work than 10 pages of calculations.”

Fee structure questions

Forensic accounting in carry cases is expensive. You should understand the cost structure upfront.

Questions to ask

“What is your hourly rate, and what’s a typical total cost for a case like mine?” Rates for experienced forensic accountants in major markets typically range from $400 to $700+ per hour. Total costs for a carry case might range from $25,000 to $100,000+ depending on complexity. Get a realistic estimate, not a lowball.
“How do you handle scope creep?” Carry cases often expand as new documents surface. Ask how they communicate cost increases and whether they provide regular billing updates.
“Do you charge separately for testimony vs. analysis?” Some experts charge a higher rate for trial testimony and deposition time. Understand the full cost picture.
“Can you estimate fees for a Phase 1 (analysis only) vs. Phase 2 (testimony preparation)?” Many cases settle after the analysis phase. Structuring the engagement in phases can help manage costs.

Red flags to watch for

Some warning signs should disqualify a forensic accountant immediately. Others are yellow flags that warrant further inquiry.

Immediate red flags

“We can guarantee a favorable outcome.” No legitimate expert guarantees results. Their job is to provide an honest, defensible analysis — not to advocate for a predetermined number.
No carry-specific experience. If they’ve never valued carried interest before, your case is not the place for them to learn. The learning curve is steep, and the stakes are too high.
Unwillingness to present a range. Any expert who gives you a single number for carry valuation without a range or sensitivity analysis doesn’t understand the asset. Carry is inherently uncertain — the valuation should reflect that.
Can’t explain their methodology in plain language. If you don’t understand their approach after a 30-minute conversation, a judge won’t understand it after an hour of testimony.

Yellow flags

Only uses one methodology. An expert who always uses Nelson or always uses time rule, regardless of the facts, may be applying a template rather than thinking critically about your case.
Doesn’t ask questions about the fund structure. In your initial consultation, the expert should be asking you questions — about the fund type, the spouse’s role, the number of funds, the stage of each fund. If they’re not curious, they may not be thorough.
Vague about timeline. Carry analyses take time because of discovery delays and document complexity. But your expert should be able to give you a reasonable timeline for their work, contingent on receiving documents.

What “good” looks like — a composite picture

Based on composite patterns from multiple successful engagements, the forensic accountant you want looks something like this:

10+ years of forensic accounting experience, with at least 5 years focused on alternative investments or fund-related compensation
Has valued carried interest in at least 5–10 cases across multiple fund types
Has testified in deposition or trial and can describe the experience specifically
Explains their methodology selection as fact-dependent, not formulaic
Presents valuations as ranges with clear assumptions and sensitivity analysis
Communicates in plain English and uses visual aids
Asks smart questions about your case before quoting fees
Provides structured, phased fee estimates with regular billing transparency
Has references from family law attorneys who specialize in high-net-worth cases

What to do next
